Laurence Marchini, Editor, writes:

Patents are fascinating things, and the world of electronics hardware has seen some pretty spectacular settlements over the past 10 and even 20 years. But such cases seldom reach the courts. The devices and concepts allegedly being copied are generally the state of the art, and companies have vested commercial interests in defending their current business plans.

In such cases, it is usually pretty clear that component x is a clear rip-off of component y, by virtue of the facts that component y was only released and patented in the last few months and that component x is a near-identical copy.

But what happens when the alleged infringement concerns a concept more than a quarter of a century old? The answer is probably “nothing”.

It does beg the question: “What does BT hope to gain from its US action against Prodigy Communications?”. Clearly, shedloads of money would be useful in BT’s current parlous state. But if that is the case, why not go after a bigger fish than Prodigy?

Theoretically, it would not just be Internet service providers who would be liable to pay royalties should the test case succeed. Almost every company and individual with a website could potentially be subject to the implications of the judgement in this case.

Fortunately it is the sheer scope of this argument that will ensure BT’s failure in its attempt to claim “ownership” of the hyperlink. The US legal system may well be the best place in the world to bring such a prosecution. But there are enough grey areas in this case to guarantee that no court in even that land would dare make a watertight judgement that far-reaching.

I hope you find this issue of our weekly newsletter useful. In addition to the new products, news and ideas featured here, there are hundreds more on our website and dozens more being added daily, so do take a look if you can.
